Services

We provide our clients with a comprehensive intellectual property rights service, which means that our clients only need to be in contact with us in the course of the intellectual property rights procedures. We represent them before the authorities (Hungarian Intellectual Property Office, courts, foreign authorities), in applications, and, if necessary, with respect to adverse parties. Our clients only need to correspond with us, and they can also settle their payment obligations through us. In the course of proceeding in their cases our clients are always represented by the same patent attorney.

Between the Office and the client there is a contractual relationship, which is certified by the contract signed by the client. In this contract the client states the task it assigns the Office and the patent attorney it appoints to proceed in its case.

If a client commissions the office for representation before the authorities (which happens in the majority of the cases), the client must also sign a power of attorney, with which our Office can prove before the authorities that it is entitled to represent the client. Patent protection serves the legal protection of inventions.

In the course of a procedure for obtaining and maintaining patent protection our patent attorneys represent our clients' interests from the beginning to the end. Cases in connection with patent protection include the following:

  • preparing formal patent applications, including appendices;
  • communication with the Hungarian Intellectual Property Office and other authorities in the course of the procedures, preparing formal statements to be made when requested;
  • registration of deadlines, notifying clients in time about the deadlines and taking the necessary steps;
  • representation in legal disputes in procedures before the Hungarian Intellectual Property Office and courts, such as deletion, infringement or negative statement proceedings;
  • payment of fees in connection with procedures aimed at granting and maintaining patents;
  • communication with foreign partners in the course of representing clients abroad in foreign (not European) patent applications;
  • our patent attorneys are also entitled to proceed before the European Intellectual Property Office in Munich, in this way we are able to represent our clients directly in European patent matters;
  • consulting in connection with any phase of patenting;
  • administration relating to granting and maintaining supplementary patent certificates;
  • administration relating to plant variety protection.

Our Office undertakes the representation of inventions in any field. At present, for example, we represent cases in the fields of the chemical industry, pharmaceutical industry, food industry, agriculture, mechanical engineering, construction industry, electronics, and we also deal with patenting biological materials (cell lines, micro-organisms, genetic and protein sequences), instruments, toys, that is any type of invention.

The trademark, as a mark, is legal protection for the identification of individual goods and services, distinguishing them from each other, and for promoting the spread of information to consumers. In the course of a procedure aimed at obtaining and maintaining trademark protection our patent attorneys represent the clients' interests from the beginning to the end. Affairs in connection with trademark protection include the following:

  • preparing formal trademark applications, including appendices,
  • communication with the Hungarian Intellectual Property Office and other authorities in the course of the procedures, preparing formal answers to be given when requested,
  • registration of deadlines, notifying clients in time about the deadlines and taking the necessary steps,
  • representation in legal disputes in procedures before the Hungarian Intellectual Property Office and courts, such as deletion or infringement proceedings,
  • payment of fees in connection with procedures aimed at the granting or renewal of trademarks,
  • communication with foreign partners in the course of representing clients abroad in foreign (not EU) trademark applications,
  • our patent attorneys are also entitled to proceed before the European Intellectual Property Office in Alicante, in this way we are able to represent our clients directly in trademark matters within the European Community,
  • consulting in connection with any phase of the trademark registration procedure.

Our Office undertakes the representation of trademarks in any field, including, for example, word trademarks, slogans, figurative trademarks or their combinations in respect of any product or service. We also deal with obtaining protection for joint or attestation trademarks and geographical marks.

Design patent protection serves the legal protection of the external form of industrial products.

In the course of procedures aimed at obtaining and the renewal of design patent protection our patent attorneys represent the clients' interests from the beginning to the end.

Our patent attorneys are also entitled to proceed before the European Intellectual Property Office in Alicante, so we are able to represent our clients directly in design matters within the European Community.

Utility model protection is a form of protection serving the legal protection of new structural constructions below the standard of patentable inventions.

In the course of a procedure for obtaining and maintaining utility model protection our patent attorneys represent our clients' interests from the beginning to the end. Cases in connection with utility model protection include the following:

  • preparing formal utility model applications, including appendices;
  • communication with the Hungarian Intellectual Property Office and other authorities in the course of the procedures, preparing formal statements to be made when requested;
  • registration of deadlines, notifying clients in time about the deadlines and taking the necessary steps;
  • representation in legal disputes in procedures before the Hungarian Intellectual Property Office and courts, such as deletion, infringement or negative statement proceedings;
  • payment of fees in connection with procedures aimed at granting and maintaining utility models;
  • communication with foreign partners in the course of representing clients abroad in foreign (not European) utility model applications;
  • consulting in connection with any phase of utility model procedure.

We undertake research in any matter regarding intellectual property rights, which means that we examine whether an application has been made for the registration of solutions identical with or similar to the examined patent, trademark, design or utility model in Hungary or abroad. If requested, we also give an expert opinion about the result of the research regarding the chances of patenting the examined solution.

History

In 1971 several patent attorneys working in the state-owned offices had the idea of establishing an independent patent office that would, as far as possible, be free of state ties. However, at that time it was not possible to set up a private office of patent attorneys, and it was not permitted to practice privately either.

A patent office working within a law office seemed to best suit the individual nature of the work of patent attorneys, where the activity of patent attorneys, closely related in many respects to law and copyright activities, could be carried out under the best possible circumstances. The then 29th Law Office in Budapest was one of the law offices that were ready and willing to create such an organisation. Following the agreement achieved with the head of the Bar Association in 1972 ADVOPATENT Patent Office started operations in January 1973 within the above Law Office with one patent attorney. In the same year in September the office had two patent attorneys and in October the number of patent attorneys increased to three. In 1976 our office was one of the few offices that were first entitled to represent foreign cases in Hungary in accordance with Ministry of Justice decree No. IM 80.060/5/1976.

For nearly 20 years the office worked within this Law Office. Then in 1991 it became possible to become independent. We immediately made use of the opportunities provided by the new system, and keeping our name, which was already known in Hungary and abroad, we founded the independent ADVOPATENT Office of Patent and Trademark Attorneys.

The Present

Today three patent attorneys work in the Office: Ms. Enikő H. Faber, György Kovári and Csaba Varannai. The patent attorneys regularly meet to exchange their experiences. We also maintain a close professional and friendly relationship with our former lawyer colleagues, and we mutually use each other's knowledge and experience whenever necessary.

Highly qualified legal assistants specialised in intellectual property rights, speaking several foreign languages also support our high quality work.

Our activities extend to all fields of intellectual property rights. All our attorneys work at a recognised, excellent professional standard, dealing with patent applications and registered designs, trademark and design applications and other contractual, litigation affairs, etc. The reputation of our office both in Hungary and abroad is demonstrated by our large number of permanent clients. In some special fields of patent protection, such as the pharmaceutical industry, food technology, agricultural chemistry and the protection of plant varieties, our office has gained international recognition.

Our wide-ranging international relations ensure that in the scope of foreign procedures we are able to represent our clients through high standard and reliable foreign offices. Especially in the developed industrial regions, in the countries of Europe, in North America and in Japan we have long-standing relationships with patent attorneys and lawyers.

Deputy Head of Office

She graduated from the Faculty of Civil Engineering of the Budapest University of Technology in 1979. She worked as a design engineer until 1986. In 1988 she obtained a higher qualification in intellectual property rights. Since 1993 she has been working for ADVOPATENT Office of Patent and Trademark Attorneys as a patent attorney.

She is a member of the Hungarian Chamber of Patent Attorneys, the Hungarian Association of Industrial Rights and Copyright Protection, the Hungarian Trademark Association, the Hungarian Group of the AIPPI and the epi.

Office Manager

He obtained his degree in civil engineering in 1959 at Budapest University of Technology. Until 1964 he worked in various fields of civil engineering. Between 1964 and 1969 he worked in the Hungarian Intellectual Property Office as a patent evaluator. As a member of the body of Hungarian experts he took part in the preparation of the Patent Co-operation Treaty in Geneva. Between 1969 and 1974 he worked for Danubia Patent Office as a patent attorney. In 1974 he joined ADVOPATENT Office of Patent and Trademark Attorneys. In 2002 he was awarded the Ányos Jedlik Prize in recognition of his outstanding activity in intellectual property rights.

He is a member of the Hungarian Chamber of Patent Attorneys, the Hungarian Association of Industrial Rights and Copyright Protection, the Hungarian Trademark Association and the epi.

Patent Attorney

He graduated from the Budapest University of Technology as an electrical engineer. First he worked at the Hungarian Research Institute of Electronic Industries. After that he worked for Ganz Electric Measuring Instruments, for Danubia Patent Office and for the Research Institute of Mining. In 1978 he joined ADVOPATENT Office of Patent and Trademark Attorneys.

He is a member of the Hungarian Chamber of Patent Attorneys, the Hungarian Association of Industrial Rights and Copyright Protection and the epi.
